EVM is ‘information’ under RTI

Chief Information Commissioner (CIC) ruled that the EVM which is available with the Election Commission of India in a material form and also as sample is an information under the RTI Act.

Key Facts:

  • As per RTI Act, 2005 – “Information” means any material in any form, including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force.
  • Record includes- any document, manuscript and file,any microfilm, microfiche and facsimile copy of a document, any reproduction of image or images embodied in such microfilm andany other material produced by a computer or any other device.
  • The Chief Information Commissioner and Information Commissioners shall be appointed by
    the President on the recommendation of a committee consisting of:
    ✓ Prime Minister, who shall be the Chairperson of the Committee
    ✓ Leader of Opposition in Lok Sabha, and
    ✓ A Union Cabinet Minister
